SMS Text Messaging Terms and Conditions
By subscribing to or agreeing to receive SMS text messages, you agree to receive messages from CarePlus Health Plans, Inc. CarePlus Health Plans, Inc. reserves the right to update or amend these Terms and Conditions at any time.
CarePlus Health Plans, Inc. and/or its clients may, at its (or their) sole discretion, terminate or suspend access to the Services or any portion thereof of any user for any reason at any time, without prior notice.
Eligibility: Unless otherwise permitted, you must be 18 years or older to use this service. No one under age 13 may use the Services under any circumstances.
Cost: There may be some costs associated with the use of CarePlus Health Plans, Inc. and its client Services. For example, your pager or cellular phone service provider may charge you to receive SMS text messages. Neither CarePlus Health Plans, Inc., its partners, nor its clients, will be held responsible for any charges related to the use of the Services.
Warranty & Disclaimer: CAREPLUS HEALTH PLANS, INC., PROVIDES THE SERVICES “AS IS” ON AN “AS AVAILABLE” BASIS WITH NO WARRANTIES OF ANY KIND. CAREPLUS HEALTH PLANS, INC., EXPRESSLY DISCLAIMS ANY WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE SECURE, UNINTERRUPTED OR FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.
Limitation of Liability: UNDER NO CIRCUMSTANCES WILL CAREPLUS HEALTH PLANS, INC., OR ITS EMPLOYEES, OFFICERS, OR DIRECTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICES WHETHER OR NOT CAREPLUS HEALTH PLANS, INC., HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SMS Text Messaging: When you opt-in to the Service, we may send you a message to confirm your signup for SMS, which may include marketing and/or informational messaging (e.g., cart reminders), depending on what you have consented to receive. When you opt-in to the informational service, we will send you a message to confirm your signup for SMS and may include informational messaging (e.g., details about programs and services you are eligible for, health reminders, and other information about using your plan). To confirm your consent to receive such messages, follow the instructions provided in the initial confirmation SMS message. Message and data rates may apply. Message frequency will vary based on your use. Text "HELP" for help. "STOP" to cancel. For all questions about the Services, you may call 800-794-5907 (TTY: 711).
You can cancel the Service at any time. Just text "STOP" to the number from which you are receiving CarePlus Health Plans, Inc., alerts. After you send the message "STOP" to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you may still receive messages from us about your plan or upcoming appointments, but you will not receive further informational and/or marketing SMS text messages. Please allow a few days for the change to be reflected in our system. If you wish to join again, simply sign up as you did the first time and we will start sending messages to you again.
If at any time you forget what keywords are supported, just text "HELP" to the number from which you are receiving CarePlus Health Plans, Inc. alerts. After you send the message "HELP" to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
Do Not Call: CarePlus Health Plans, Inc., maintains a subscription to the National Do-Not-Call Registry (“NDNC”) to prevent certain informational and/or marketing communications to consumers properly registered on the NDNC. CarePlus Health Plans, Inc., indefinitely prohibits the placement of calls to any consumer properly registered on the NDNC, so long as the registration has not been cancelled by the consumer or removed by the NDNC administrator. This does not apply to consumers who have provided their prior express consent, or prior express written consent, as applicable, to be contacted.
CarePlus Health Plans, Inc., also maintains an internal do-not-call list. If your telephone number changes or you add an additional telephone number, it is your duty to provide CarePlus Health Plans, Inc., with your new telephone number to replace or supplement the phone number previously placed on the CarePlus Health Plans, Inc. internal do-not-call list.
Please note that CarePlus Health Plans, Inc., only restricts calls from CarePlus Health Plans, Inc., that are subject to the applicable federal and state laws, so consumers may continue to receive calls that are not subject to applicable federal and state laws, or from other companies that are not affiliated with CarePlus Health Plans, Inc. Consumers should visit www.donotcall.gov to add their number to the NDNC.
Participating carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central, IL (ECIT), Cellular One of Northeast Pennsylvania, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).
T-Mobile and other carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. For all questions about the Services, you may call 800-794-5907 (TTY: 711).
If you are dissatisfied with the Services, discontinue using the Services by opting out as described herein. To the extent permitted by applicable law, we disclaim any liability arising from your use of the Services. You acknowledge, by your use of the Services, that your use of the Services is at your sole risk.
Indemnity: You agree to indemnify, defend and hold harmless CarePlus Health Plans, Inc., its partners, clients, employees, officers and directors, from and against any and all claims, liabilities, penalties, settlements, judgments, fees (including reasonable attorneys’ fees) arising from (i) any content that you or anyone using your account may submit, post or transmit using the SMS text messaging Service in an unauthorized manner; (ii) your violation of these Terms and Conditions; and (iv) any violation or failure by you to comply with all laws and regulations in connection with the Services.
You may not assign any of your rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without the prior written consent of CarePlus Health Plans, Inc. Any such purported assignment or delegation by you without the appropriate prior written consent of CarePlus Health Plans, Inc., will be null and void and of no force or effect.
This program is available to subscribers of Verizon Wireless, AT&T, Sprint, T-Mobile®, U.S. Cellular, Virgin Mobile, Boost Mobile, MetroPCS, Alltel, Cellular One, ACS/Alaska, Bluegrass Cellular, Cellular One of East Central Illinois, Centennial Wireless, Cox Communications, EKN/Appalachian Wireless, GCI, Illinois Valley Cellular, Immix/Keystone Wireless, Inland Cellular, Nex-Tech Wireless, Rural Cellular Corporation, Thumb Cellular, United Wireless, West Central (WCC), Cellcom, Cellsouth, Cricket, and Cincinnati Bell. T-Mobile® is not liable for delayed or undelivered messages. You also agree to our SMS Terms & Conditions. Unless otherwise permitted, you must be 18 years or older to use this Service.
These Terms and Conditions apply in addition to any other terms that may apply to your use of services provided by CarePlus Health Plans, Inc.
